I agree with Judge Kavanaugh’s view of the judiciary’s role in this government … the judiciary rules in strict accord with the Constitution, on the validity of laws made in the Constitution’s presence. The judiciary interprets laws in strict adherence to their text, but it does not make law.


I believe in the Constitution as a living document. However, it spells out EXACTLY how the people of the United States can undertake changing any of its provisions. Those provisions do not support evading the law and procedures embodied in that Constitution (like the move by a collection of states to undermine the electoral college).


It provides for a Constitutional Convention wherein the states can alter the Constitution, but it does not provide for any calling a form of such a convention that is limited in scope as to what Articles or Amendments can be addressed. As such, there are significant concerns with calling for such a convention in times as polarized as these. In the light of more than 200 years of (arguably) successful governance (we’re still here, aren’t we), the call for such a convention is not one to be taken lightly.
